Replacement car

If your car has been damaged in a collision due to someone else's fault you are entitled to a replacement paid for by the guilty party's insurer.

In order to get a replacement you should visit the insurer’s office and present a written statement to the effect that the damaged vehicle was essential for your work. Receipt of such a statement should be acknowledged by the insurer with a stamp and the time of receipt should be given. A good idea is to include copies of your business’ documentation with the claim form (including your NIP and REGON numbers as well as business registration)

The other party’s insurance company should cover the cost of a replacement vehicle hire, as long as the vehicle is of comparable or lower standard.

The law (Kodeks cywilny art. 361, 363 i 415 oraz Rozporządzenie Ministra Finansów z dn. 24.03.2000 r. Dz.U. nr 26 poz. 310 w sprawie OC)  states that the provider of liability insurance is required to satisfy the claim to such a degree, that the claimant suffers no major discomfort because of the accident.

The cost of repairing the damage to the car and a replacement car hire are only some of the claims that are available.
